These Terms of Service ("Terms") govern your use of the website at mistletoeconstruction.com (the "Site"), operated by Mistletoe Construction LLC, 595 E Third St, Riddle, Oregon 97469 ("Mistletoe Construction," "we," "us"). 1. Informational content only
Our guides, glossary, FAQ answers, and other Site content are general information about roofing and construction in Oregon. They are not professional advice about your specific roof, home, or project. Every roof is different — until we've actually inspected yours, nothing on this Site should be treated as a diagnosis, recommendation, or promise about your particular situation.
2. Estimates
Any pricing, timeframes, or scope discussed on the Site or in a preliminary estimate are informational and non-binding. All work is subject to an on-site inspection and a written contract signed by both parties. The written contract — not this Site — governs any project we perform for you.
3. No warranty on Site accuracy
We work hard to keep the Site accurate and current, but we provide it "as is" and "as available," without warranties of any kind, express or implied, including accuracy, completeness, or fitness for a particular purpose. Building codes, material specifications, and manufacturer programs change; always confirm current details with us directly.
4. Intellectual property
The Site's content — text, guides, photographs of our work, logos, and design — is owned by Mistletoe Construction LLC or used with permission. You may view and share links to our content, but you may not copy, republish, or use it commercially without our written permission. Our project photos show real jobs by our crew; please don't pass them off as someone else's work.
5. Acceptable use
You agree not to: misuse the Site or interfere with its operation; attempt to access accounts or systems you're not authorized to access; scrape or harvest data from the Site; submit false, misleading, or malicious content through our forms; or use the Site for any unlawful purpose.
6. Client portal
If you create or use a client portal account, you agree to provide accurate account information and keep your login credentials secure. You are responsible for activity under your account. Portions of the portal may be offered in a demonstration or preview status; features, data displays, and availability may change or be discontinued without notice while in that status. The portal is a convenience — your written contract and our direct communications remain the authoritative record of your project.
7. Limitation of liability
To the fullest extent permitted by law, Mistletoe Construction LLC will not be liable for indirect, incidental, special, or consequential damages arising from your use of the Site, and our total liability related to the Site will not exceed one hundred dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law, and nothing here limits or modifies the terms of any written construction contract between us.
8. Governing law
These Terms are governed by the laws of the State of Oregon, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Site will be resolved in the state or federal courts located in Oregon, and you consent to venue there.
9. Changes to these Terms
We may update these Terms from time to time. When we do, we'll update this page and the effective date at the top. Your continued use of the Site after changes take effect means you accept the updated Terms.
